3M Rev Your Engines Turbo Sweepstakes
NO PURCHASE NECESSARY. No purchase necessary to win. A purchase does not improve your chances of winning. By entering the Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules. Void where prohibited, taxed or restricted by law. All federal, state and local laws and regulations apply.
SPONSOR: 3M Consumer & Office Division, a division of 3M Company, St. Paul, MN 55144 (“Sponsor”). Apple is not a participant in or sponsor of this promotion.
DEADLINES AND ELIGIBILITY REQUIRMENTS. The 3M Rev Your Engines Turbo Sweepstakes (“Sweepstakes”) begins 12:01:00AM Central Standard Time (“CST”) on August 15, 2011 and ends at 11:59:59 PM CT on December 31, 2011 (“Sweepstakes Period”). Sponsor’s computer will be the official time clock for the Sweepstakes. Sweepstakes is open to all legal residents of the United States who are 18 years of age and older at the time of entry (except residents of NE and AL must be 19 years of age and older). All online entrants must have a valid e-mail address. In the event of a dispute regarding the identity of the person submitting an online entry, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may require proof to its satisfaction of entrant’s registered subscriber status. Automated entries (including but not limited to entries made using any script, macro, bot, or sweepstakes service) and facsimiles are not allowed.
HOW TO ENTER: Go online to www.revyourengines.com (“Site”) and follow the online instructions to complete the registration form, including your complete first and last name, street address (no P.O. Boxes), city, state, zip code, telephone number, date of birth and email address. All required steps specified herein and on the Sites are referred to as the “Entry”. Understanding and acceptance of the Official Rules must be acknowledged by clicking on the “I’ve read and agree to the Rev Your Engines Turbo Sweepstakes Rules” check box. Once the Entry is completed and submitted as directed by the online instructions, you will receive one (1) Entry in to the Sweepstakes. Limit one (1) Entry per person/per email address per day. Entries must be received by 11:59:59 PM CT on December 31, 2011. Any other form of Internet or e-mail entry is void. Sponsor, its agencies and the Released Parties assume no responsibility for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone or computer hardware or software or telephone transmissions or technical failures; ISP/network/Website accessibility or availability; garbled or jumbled transmissions; injury or damage to any participant’s or any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website; and/or other errors of any kind, whether human, mechanical or electronic, including without limitation the incorrect or inaccurate capture of online entry information. Online entry data that have been tampered with or altered in any way are void. Any use of robotic, automated, programmed, or like online entry methods is prohibited. Sponsor’s computer is the official timekeeping device for the Sweepstakes.
PRIZE DESCRIPTIONS AND APPROXIMATE ODDS OF WINNING: One (1) Grand Prize winner will receive a 2012 Ford Focus SEL. The approximate retail value (“ARV”) is no greater than twenty-two thousand dollars ($22,000). The winner is responsible for tax, license, title fees and insurance for the Grand Prize and any other costs to own and operate the Grand Prize. Five (5) Second Place Prizes shall be awarded:
Apple® gift card. ARV: $500.00. Twenty (20) Third Place Prizes shall be awarded: 3M Racing merchandise packs. Prize includes 3M Racing duffle bag, cap, 1:24 scale Officially Licensed NASCAR® die-cast car and t-shirt. ARV: $100.00. If any winner cannot accept prize as stated, such winner’s prize will be forfeited and an alternate winner will be selected. This Sweepstakes is subject to all federal, state and local laws. Limit one (1) prize per entrant. Sponsor reserves the right to substitute prizes of comparable value. No transfer or substitution of a prize is permitted except by Sponsor. The number of eligible entries will determine odds of winning.
DRAWING: One (1) grand prize winner, five (5) second place winners and twenty (20) third place prize winners will be selected in a random drawing held on or about January 15, 2012 from all eligible entries received. Drawings will be conducted under the supervision of an independent judging organization, whose decisions will be final in all matters pertaining to this Sweepstakes. Odds of winning depend on the number of entries received. If any prize correspondence (including e-mail) is returned as non-deliverable, prize may be forfeited and an alternate winner will be selected. Potential winners of a prize are subject to verification by Sponsor. Any materials submitted become the sole property of the Sponsor and will not be returned. No more than the advertised number of prizes will be awarded. Limit of one (1) prize per entrant. The potential winners will be notified by mail, phone or email. Decisions of the random drawing are final. All prizes will be awarded provided a sufficient number of entries are received. Sponsors has up to ninety (90) days, excluding any delay for special order vehicle customization or vehicle manufacturing production delays, to arrange delivery of the Grand Prize to the winner of the Sweepstakes following selection by Ford and Sponsor of the authorized Ford dealer where the Grand Prize will be delivered. Ford and Sponsor are not responsible for delays in delivery beyond their control. GENERAL RULES: Employees of 3M and the “Promotional Participants” (i.e., Ford Company, E Group, Inc., and each of their respective agencies, parents, subsidiaries, affiliates, vendors, officers, directors, agents, wholesalers and retailers involved in this Sweepstakes) Roush Fenway Racing, its affiliates and each of their respective directors, shareholders, officers, employees, members, agents and affiliates, and NASCAR, Inc. and its affiliates and each of their respective employees, shareholders, officers, directors, agents, members, successors and assigns (collectively the “Released Parties”) involved in this Sweepstakes and their immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, and half-sister and spouse’s of each) and/or those living in the same household of each are not eligible. No substitution, cash redemption or transfer of prize by winner permitted, other than those stated herein. All federal, state and local taxes are the sole responsibility of the winner. All federal, state and local laws and regulations apply. Grand Prize winner will be issued an IRS 1099 form for the ARV of the prize. All materials submitted become the property of the Sponsor and will not be acknowledged or returned. Potential Grand Prize winner must sign and return an Affidavit of Eligibility/Release of Liability Form, where permitted, within four (4) days of attempted notification. Noncompliance within this period will result in disqualification and an alternate winner may be selected, time permitting. Return of any prize notification as undeliverable will result in disqualification and an alternate winner may be selected, time permitting. Sponsor, in its sole discretion, reserves the right to substitute prize of equal or greater value. Sponsor and the Released Parties are not responsible for the quality or utility of any prize, nor are Sponsor or the Released Parties responsible for delays in delivery of any prize. Sponsor makes no warranty with respect to any prize. By accepting prize, winner consents to the use of his/her name, photograph or likeness for publicity or advertising purposes without further compensation or permission, except where prohibited by law. By participating, entrants agree to release and hold harmless Sponsor and the Released Parties from any and all liability with respect to or in any way arising from or in connection with this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, bodily injury, death, damages and/or loss. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges. The failure of either Sponsor or the Released Parties to comply with any provision of these Official Rules due to an act of God, act of domestic terrorism, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of either (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules. Sponsor and the Released Parties are not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the Sweepstakes. If an entrant to the Sweepstakes (“Entrant”) elects to receive information from either Ford or Ford Racing, then such information will be subject to the Ford Motor Company Privacy Policy, http://ww.flmowner.com/servlet/ContentServer?mainpage=privacy&pagename=Owner%2femailpreferences%2FWrapper, and/or Ford Racing’s Privacy Policy, www.fordracingevents.com./privacy.aspx. Electing to receive information from Ford and/or Ford Racing, Entrant agrees to i) Sponsor’s collection and usage of their personal information, ii) to the Sponsor forwarding such information to Ford and/or Ford Racing, and iii) acknowledges that they have read and accepted the Ford and/or Ford Racing privacy policies.
LIMITATIONS TO LIABILITY: The Released Parties are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic, clerical or human error which may occur in the administration of the Sweepstakes or the transmission, receipt or processing of entries or notification of winners; or (v) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this Sweepstakes if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the Sweepstakes. In the event of termination, remaining prizes will be awarded in a manner to be determined by Sponsor consistent with state requirements. Under no circumstances, including negligence, shall the Released Parties be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the web site, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR’S WEB SITE IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Any attempt by an entrant or other individual to deliberately damage any web site or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.
WINNER’S LIST: For an official list of the winners, or to receive a copy of these Official Rules, send a self-addressed stamped envelope in a separate first class stamped envelope to: 3M Rev Your Engines Turbo Sweepstakes Win List Request, c/o E Group, Inc., 901 N 3rd St, Suite 195, Minneapolis, MN, 55401, to be received no later than January 31, 2012.
